TERM

The Cute Character Bento Contest 2015  (the “Contest”) begins January 15, 2015 at Noon US Pacific Standard Time (“PST”) and ends February 22, 2015, Noon US Pacific Standard Time (“PST”). ALL ENTRIES MUST BE RECEIVED BY February 22, 2015 AT Noon PST. Information on how to enter and prizes form part of these official rules (“Official Rules”). By submitting an entry, each entrant agrees to the Official Rules and warrants that his or her entry complies with all requirements set out in the Official Rules. This is a skill-based contest and chance plays no part in the determination of winners. No purchase or payment of any kind is necessary to enter or win this Contest. A purchase or payment of any kind will not increase chances of winning.

 

ORGANIZERS OBTAINS RIGHTS FROM ENTRANTS TO POST AND USE ANY AND ALL CONTENT SUBMITTED AS PART OF THE CONTEST. CONTENT MAY BE FEATURED IN PHOTO EXHIBITION, OR AT ORGANIZERS AND SUPPORTER'S WEB SITES, OR SOCIAL MEDIA CHANNELS. ONLINE ENTRY ONLY.

 

BY ENTERING (OR OTHERWISE PARTICIPATING IN) THE CONTEST, YOU AGREE TO THESE OFFICIAL RULES.

 

ORGANIZERS AND SUPPORTERS

Organizers are BentoUSA by AllThingsForSale (hereinafter called "BentoUSA"), and the Consulate General of Japan in Los Angeles (hereinafter called "The Consulate").
Judges are the Consulate, BentoUSA, and Ochikeron.
Supporters are All Nippon Airways (hereinafter called "ANA"), Nijiya Market, Mitsuwa Marketplace, Marukai Corporation, BentoUSA, CuteZCute Inc., and Kinokuniya Book Stores of America

 

WHO MAY ENTER

This Contest is open only to individuals who reside and have a shipping address in the United States of America. For United States' residents, entrants must be legal residents and at least twenty-one (21) years of age or older at the time of entry.

Employees, officers and directors of Organizers, Supporters, and Judges ("we", "us", "ours"), and each of such employees’, officers’ and directors’ immediate family members and/or those living in the same household (whether legally related or not) of each are not eligible to enter the Contest or win a prize but are eligible to have their Submission(s) posted on our web site. For purposes of this Contest, immediate family members are defined as spouse, partner, parents, legal guardians, in-laws, grandparents, siblings, children and grandchildren and those living in the same household shall mean people who share the same residence whether legally related or not. Void where prohibited by law.

 

WHAT TO ENTER:

Submission should be photos of a cute character bento fitted in a food container. Images should highlight the food/bento itself and be of good quality for printing on a panel (recommending 3000 x 4500 pixels). To enter, visit www.allthingsforsale.com/bento/contest; complete an entry form with the required information stated below.

The Categories for entries are: (1) bread-based bento, (2) rice-based bento, (3) pasta-based bento, and (4) bento that do not fall under the other categories (the "Categories"). Each entry must comply with the following requirements. Entries that do not meet the following requirements are subject to disqualification, at Judges' sole and absolute discretion.

1. Arrangement of the food must be no larger than an actual size of 10” x 10”. Anything fitting within these measurements is acceptable, including but not limited to bento box, lunch box, and other containers. Food decorated on a dish or plate is not allowed.

2. Submit a digital photo of your food decoration to BentoUSA, including the following information in English. Entries must be submitted before February 22 2015, Noon Pacific Time.

3. One person can submit up to ten separate, distinct creations as individual photos.

4. Photos must not include photographs of people. (The photo should only include the bento. No people or children, including the bento-maker should be present in the photo.) Photos must not include any licensed characters.

5. Photos must be JPG, JPEG format, of good quality (preferable high resolution).  Take photos using the largest JPG or JPEG setting on your camera, or at high resolution with a minimum  3000 x 4500 pixels.  If your photo is chosen as a 1-10 winners, your photo will be printed to as large as a 32 x 40 inch panel without adding any modifications on it. Panels will be exhibited at the Japan Foundation, Los Angeles between March 13th to 28th 2015. The Consulate retain the right to possess and exhibit the panels additionally to the above said exhibitions without further notice to the awarded entrants. Photos that do not meet this standard can still be judged, but may not be honored as a finalist in the competition (at the judges’ sole discretion) if the photographer is unable or unavailable to provide the proper resolution when asked.

6. All photos and designs must be original; created solely by the entrant; have never been submitted in any other contest or won any previous awards; have never been published in any publication, (personal blog is accepted); and must not infringe the rights of any third party.  Previously published material for which non-exclusive rights were granted may be entered as long as entrants still maintain the right to grant the Organizers and Supporters a license (see “Releases” below). Entrants must be able to disclose when and where the photo appeared previously to the Organizers upon request.

7. Entries must not display any commercial/corporate advertising as determined by the Organizers.

8. Entries may be watermarked if desired, but the watermark should be inconspicuous enough to not interfere with the judging of the photo. Watermark position should only be at the bottom right corner. A watermarked photo might not be honored by the competition (at the judges' sole discretion) if the watermark is too conspicuous or photographer is unable or unavailable to provide a pristine, watermark-free version of the image when asked.

9. Photos that do not meet the aforementioned requirements may or may not be judged at the Judges' sole discretion.

 

SCHEDULES

Online entries can be uploaded starting January 15, 2015 at Noon US Pacific Standard Time (“PST”). Deadline for submitting entries is February 22, 2015, Noon PST.  Entrants may be asked to supplement their submission with additional information or materials (such as a paragraph about their photo, the highest resolution version of their photo, or a watermark-free version of their photo) anytime on or after February 15, 2015 – February 28, 2015.  The Grand Prize winner and Runners Up will be announced on March 7, 2015. The Organizers reserve the right to adjust any deadline(s) as the result of causes beyond its immediate control.

 

PRIZE

All the prizes will be shipped separately by the respective supporting companies. As such, Organizers cannot estimate the timing of the shipping of the prizes.

 

Grand Prize includes

- An Award Certificate from the Consulate General of Japan in Los Angeles
- One round-trip ticket from the US to Japan presented by All Nippon Airways (ANA) with the following limitations***
- A $300-$400 value rice cooker presented by one of the leading Japanese supermarkets (Nijiya Market, Mitsuwa Marketplace, Marukai Corporation)
- A $100-value bento prize pack from BentoUSA
- A $50-value bento prize pack from CuteZCute
- A Cookbook from Kinokuniya Book Stores of America
- A food gift bag from Nijiya Market

***The All Nippon Airways (ANA) round-trip ticket to Japan is subject to the following conditions:
- Ticket is valid for roundtrip travel, in economy class, from selected US cities to Tokyo (Narita).
-Travel may originate at any of ANA’s eight US Gateways; Honolulu, Los Angeles, San Francisco, San Jose, Seattle, Chicago, Washington D.C., or New York.
-Applicable transportation taxes and fees are the responsibility of the award winner; the winner must verify the applicable amount with an ANA Customer Service representative. 
-Travel must be completed by the date stated on the award letter (approximately one year from the date of the winner announcement).
-Travel is not allowed on the following black-out dates: April 25~May 6, August 1~August 16, December 19~January 3
-Travel award is non-transferable, non-endorsable and may only be used by the person to whom it is awarded.
-Determination of tax liability on travel award is the responsibility of the user.

***If the primary winner is unable to receive the grand prize of a round-trip ticket to Tokyo, the said prize will be given to the secondary winner. If the secondary winner  is unable to receive the grand prize of a round-trip ticket to Tokyo,  the said prize will be given to the tertiary winner. In case all top three winners are not able to receive the grand prize of a round-trip ticket to Tokyo, the said prize will be forfeited and no cash alternative will be offered. 

Second Prize and Third Prize, each includes:

Prizes are non-transferable, with no cash redemptions, equivalents or substitutions, except at Organizers' sole and absolute discretion. Prize details and availability are subject to change and prize provider’s rules and restrictions, and in the event that one of Supporters is unable to provide a Winner with his/her prize, Supporters may elect, to provide Winner with the approximate value of such item in cash or award an alternate prize of comparable or greater value. In the event a Winner engages in behavior that (as determined by Supporters or any prize provider in its or their sole and absolute discretion) is obnoxious, inappropriate, or threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person, Supporters reserves the right to terminate the right to receive a prize. All prizes are awarded “AS IS” and without warranty of any kind, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). Prize winners will be solely responsible for all federal, state and/or local taxes, and for any other fees or costs associated with the prizes they receive, regardless of whether they, in whole or in part, are used. The ARV of the prizes is based on available information provided to Organizers and Supporters and the value of any prize awarded to a winner may be reported for tax purposes as required by law. The winners may be required to provide Organizers with a valid social security number or tax identification number before the prizes will be awarded for tax reporting purposes. An IRS Form 1099 may be issued in the name of winners for the actual value of the prizes received. Unclaimed prizes will be forfeited.

 

JUDGING

Judging consists of three (3) rounds of evaluation.

Images will be judged on creativity, originality, technical excellence, composition, overall impact and photo quality.
Judging entities and individuals will consist of representatives from the ConsulateBentoUSA, and YouTube personality and bento expert Ochikeron.

Among the posted photo entries, 10 winners will be chosen by the Consulate and BentoUSA, from the following categories: 3 bread-based bento, 3 rice-based, 2 pasta-based and 2 bento that do not fall under the other categories. The Consulate and BentoUSA will select the top 10 finalists. Ochikeron will select the top 3 finalists from among the top 10 finalists. The Consulate will select grand prize, second prize and third prize winners from the top 3 finalists.

Winners will be chosen on or about March 7, 2015 and will be notified by e-mail. The Organizers are not responsible for false, incorrect, changed, incomplete or illegible contact information. Notification is deemed to have occurred immediately upon sending of an email or other electronic message, one (1) day after sending via a delivery service or two (2) days after mailing. If Organizers are unable to contact a potential Winner or a potential Winner is not in compliance with these Official Rules, the prize will be forfeited and, at Organizers' discretion, an alternate winner will be selected. 

The judges shall determine winner eligibility in its sole and absolute discretion. All decisions made by the judges are final and binding.

 

RELEASES

If the photograph contains any material or elements that are not owned by the entrant and/or which are subject to the rights of third parties, the entrant is responsible for obtaining, prior to submission of the photograph, any and all releases and consents necessary to permit the exhibition and use of the photograph in the manner set forth in these Official Rules without additional compensation.

You will retain all rights to any photograph you submit -- including ownership if applicable. You only grant the Consulate and BentoUSA rights to your photograph a no-cost license, nonexclusive right, to reproduce, distribute, display, and create derivative works of the entry, use your display name, photo title and brief description of the photos in promotions and other publications, in connection with your entry, and keep the files provided, and to archive the images on computer media or in other electronic forms, so that your photos can be used and/or be properly credited, if allowed, in all forms of media and by any and all means and media (now and hereafter known), and on and in connection with related products, services, advertising and promotional materials (now known or hereafter developed), worldwide, in perpetuity, without any obligation, notice or consideration except for the awarding of the prizes to the winners.

As a condition of entering the Contest, each entrant gives consent for Organizers to obtain and deliver his or her name, address and other information to third parties for the purpose of administering this Contest and to comply with applicable laws, regulations and rules. Any information entrants provide to Organizers may be used to communicate with entrant in relation to this Contest or on a Contest Winners list. Information and materials submitted by or collected from entrant are subject to Organizers' privacy policy.

 

SUSPENSION / MODIFICATION / TERMINATION

In the event Organizers are prevented from continuing with the Contest by any event beyond its control, including, but not limited to, fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, communications or equipment failure, utility or service interruptions, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), interference with the Contest by any party, or any federal, state or local government law, order, or regulation, order of any court or jurisdiction, or other cause not reasonably within Organizers' control (each a “Force Majeure” event or occurrence) Organizers shall have the right to modify, suspend or terminate the Contest.  If Organizers elect to cancel or terminate the Contest, Organizers will not retain any rights in the submitted photographs.

 

GOVERNING LAW / LIMITATION OF LIABILITY

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of entrants, Organizers, Judges, and Supporters in connection with the Contest will be governed by and construed in accordance with the internal laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state’s laws.

 

BY ENTERING THE CONTEST, ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (A) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE CONTEST, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (B) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED TEN DOLLARS ($10.00), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (C) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES NOT TO EXCEED TEN DOLLARS ($10.00), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (D) ENTRANTS’ REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU.
